Position Summary
The Title IX & DHR Case Manager/Investigator is fundamental to the University’s equity, inclusion and compliance efforts. Reporting to the Equity Programs & Compliance Executive Director (Title IX Coordinator/DHR Administrator), the Title IX & DHR Case Manager/Investigator will provide administrative and investigative support to the Title IX Coordinator/DHR Administrator regarding confidential, sensitive and complex matters. The Case Manager/Investigator will manage and prioritize cases, issues and requests, and prepare and proofread investigation reports, correspondence, presentations and relevant material.
The Title IX & DHR Case Manager/Investigator communicates effectively, maintains neutrality, meets deadlines and works effectively and respectfully with diverse constituencies to help create and support a safe and inclusive campus environment. Incumbent develops and maintains relationships and clear lines of communication with students, faculty, staff and administration. Incumbent receives reports of Sexual Misconduct, Sexual Harassment, Domestic Violence, Dating Violence, Stalking, Discrimination, Harassment and/or Retaliation, identifies university policies relevant to a complaint, conducting party and witness interviews, organizing and maintaining appropriate files for all cases, including but not limited to correspondence and notes of interviews/meetings, and resolve complaints while ensuring University policies are followed and enforced.
The Title IX & DHR Case Manager/Investigator is responsible for assisting in the development and maintenance of accurate record-keeping systems and reports, assisting in compliance with federal and state reporting and training mandates, running reports to provide statistical support for office priorities/obligations. The incumbent is also responsible for receiving reports of Sexual Misconduct, Sexual Harassment, Domestic Violence, Dating Violence, Stalking, and Discrimination, Harassment, and Retaliation on the basis of a protected status, identifying university policies relevant to a complaint, and actively fostering and maintaining a climate that is supportive of students, faculty and staff.
When appropriate, incumbent conducts prompt, thorough, fair, and impartial investigations pursuant to requirements set forth in California State University (CSU) Executive Orders. The incumbent informs interviewees of their rights, responsibilities, and applicable procedures, conducts unbiased interviews of parties and witnesses, and ultimately submits a detailed investigation report containing investigation findings. Incumbent must exercise independent judgment in making recommendations regarding continuous quality improvement in unit investigation operations.
The Title IX & DHR Case Manager/Investigator will conduct investigations in accordance with best practices in civil rights investigations, applicable CSU policies and procedures, ethics and due process, and in a trauma-informed manner. The incumbent must correspond with investigation participants and University stakeholders, produce comprehensive, clear and well-reasoned investigation reports, represent the University at hearings required by CSU Executive Orders, and assist with post-investigation follow-up with affected students, faculty, employees, departments and/or divisions.
Incumbent is expected to work independently with minimal day-to-day oversight and under general instruction on new assignments. Incumbent keeps the Title IX Coordinator/DHR Administrator and other appropriate unit administrators informed of progress, potentially controversial matters, and implications of work performed. The incumbent must be able to handle highly sensitive and potentially political matters with tact and discretion, maintaining confidentiality as appropriate.
The Title IX & DHR Case Manager/Investigator assists in the identification of patterns of behavior and systemic problems, facilitates solutions, and performs other duties as assigned. The incumbent is also expected to maintain accurate and complete records of all investigations in a timely manner, honoring all applicable records retention policies and protocols. The incumbent will assist in conducting training on sexual misconduct, sexual harassment, domestic violence, dating violence, stalking and discrimination, harassment and retaliation, as directed. The incumbent will also assist with informal resolution of complaints that do not go to investigation.
Special Working Conditions: Incumbent must be able to competently interact with a culturally and ethnically diverse population of students, faculty and staff. Incumbent will interact regularly with the Dean of Students Division, Labor Relations & Employee Development, and Student Affairs & Enrollment Management staff. Minimum Qualifications
• Bachelor’s degree from an accredited four-year college or university in a relevant discipline.
• Professional knowledge of Title IX, Clery Act, VAWA, FERPA, Equal Employment Opportunity (EEO) affirmative action, the Americans with Disabilities Act and other applicable federal and state civil rights and employment laws, regulations and court decisions.
• Knowledge of principles of conducting investigations, including interview methods and techniques.
• Knowledge of principles of social justice.
• Knowledge of principles of cultural competence.
• Ability to work independently, take initiative and handle highly sensitive and confidential information appropriately.
• Strong and effective interpersonal skills, including the ability to establish rapport with a diverse range of community members.
• Ability to develop and maintain effective, collaborative working relationships.
• Commitment to principles of due process, fairness, ethical conduct and respect.
• Excellent writing and research skills and the ability to generate concise and analytical reports about complex and sensitive investigations.
• Must have exceptional organization skills, including the ability to handle a significant caseload and manage multiple deadlines.
• Must be proficient in Word, Excel, PowerPoint, Adobe and Zoom.
Preferred Qualifications
• Juris Doctor with two or more years of law firm experience or an equivalent combination of education and law experience.
• Two (2) years’ experience in Student Conduct, Title IX, DHR (Discrimination, Harassment & Retaliation), EEO or employee relations complaint and/or grievance investigation and resolution.
• Experience in a higher education setting preferred, public higher education.
• Certification for Title IX Investigator, Civil Rights Investigator or Workplace Investigator.
• Recent advanced level professional training on workplace investigation best practices.
• Proficiency with Maxient or other case management software.
